This new role has responsibilities similar to the former CDM-Co-ordinator, although some of these duties have passed to the 'Client' and/or 'Principal Contractor', (e.g. project notification).


The Party Wall etc. Act 1996 is legislation which comes into force when construction work is undertaken which may have an effect on an adjacent building or structure. The purpose of the act is to safeguard the interests of property owners or tenants on both sides of a party wall line whilst construction work is in progress. It also provides a framework for the resolution of disputes between adjoining owners should they arise.


Asbestos containing materials (ACM's) within buildings remain a major hazard to health and safety within the construction industry.  Although now banned within the UK, their use was phased out very gradually. As a result ACM's may still be present within buildings constructed or refurbished as recently as 2000.


In addition to our core business, we also are also able to assist clients with matters in relation to the Party Wall etc. Act 1996. John Loades is a particularly well experienced in Party Wall Surveyor and is a member of the Pyramus & Thisbe Club which, founded in 1974 by leading party wall surveyors, seeks to advance knowledge of party wall legislation and procedure and to promote best professional practice in its application. 

The Construction {Design & Management} or 'CDM' Regulations relate to the management of health & safety in construction.  The regulations represent legislation that is enforceable by law and are therefore extremely important.  Originally introduced in 1995, the regulations were updated in 2007 and again in April 2015. Under the new regulations the old CDM Co-ordinator role has been replaced by that of the Principal Designer, the responsibility placed upon the client has increased and all construction projects are required to be managed in line with the regulations, even those involving domestic clients.  JMLA have been involved in CDM management since the introduction of the original regulations back in 1990's and have considerable expertise in this area.  John Loades is a Chartered Structural Engineer, a member of the Institution of Structural Engineers and brings with him more than ten years' experience working as a Planning Supervisor and latterly a CDM Co-ordinator.  Phil Miers is an associate member of the Institution of Structural Engineers and is also a registered CDM-C member of the Association for Project Safety (APS) which is the UK's foremost professional body involved in the management of health & safety in construction.

Asbestos remains a real danger within the construction industry and within buildings generally. Work undertaken close to, or actually involving Asbestos, is covered under the Control of Asbestos Regulations which are both complex and legally binding. This is yet another area where JMLA are able to assist by undertaking sampling and analysis Surveys or by advising clients and providing assistance in relation to the management of Asbestos. All work of this type is undertaken by Phil Miers who holds the British Occupational Hygiene Society P402 Certificate in Building Surveys and Bulk Sampling for Asbestos.
